Terms and Conditions

1. Who can use Jimwala

You must be at least 18 and be able to make a binding contract in India. You use Jimwala for a gym, fitness club, yoga studio or similar business. If you sign up for a business, you confirm you have the authority to accept these terms for it.

2. What Jimwala does

Jimwala is software that helps a gym manage members, memberships, fees, attendance, enquiries, messages and a website. We provide the software. We do not run your gym, and we are not a party to anything between you and your members.

3. Free trial

Every new gym gets a 14-day free trial with 30 offer messages. No payment is needed to start. The trial is there so you can test Jimwala properly before you pay. When it ends, you need a paid plan to keep using the paid features.

4. Plans and payment

Our plans are prepaid for the period you choose:

• Starter monthly: ₹549 for 30 days, up to 100 members, with 20 offer messages
• Starter quarterly: ₹1,497 for 90 days, up to 100 members, with 60 offer messages
• Starter halfyearly: ₹2,694 for 180 days, up to 100 members, with 120 offer messages
• Starter yearly: ₹4,788 for 365 days, up to 100 members, with 240 offer messages
• Growth monthly: ₹849 for 30 days, up to 300 members, with 40 offer messages
• Growth quarterly: ₹2,247 for 90 days, up to 300 members, with 120 offer messages
• Growth halfyearly: ₹4,044 for 180 days, up to 300 members, with 240 offer messages
• Growth yearly: ₹7,188 for 365 days, up to 300 members, with 480 offer messages
• Pro monthly: ₹1,249 for 30 days, unlimited members, with 80 offer messages
• Pro quarterly: ₹3,387 for 90 days, unlimited members, with 240 offer messages
• Pro halfyearly: ₹6,144 for 180 days, unlimited members, with 480 offer messages
• Pro yearly: ₹10,788 for 365 days, unlimited members, with 960 offer messages
• Prices are in Indian rupees and are final: we are not registered for GST, so no GST is charged. If that changes, prices for future purchases will say so.
• Each plan allows a number of active members (members who left do not count). To add more, move to a bigger plan.
• You pay in advance, online through PayU, and your plan starts once we receive the payment.
• If your plan ends, everything keeps working for 7 more days. After that your gym becomes read-only: you can still see all your data, but you cannot add or change anything until you renew. We do not delete your data because a plan ended.
• Plans do not renew on their own. To carry on after a period ends, you pay for a new one.
• We may change our prices for future purchases. A change never affects a period you have already paid for.

5. No refunds

All payments to Jimwala are final and non-refundable, including for unused days and unused offer messages. Please read our Refund and Cancellation Policy, which is part of these terms.

6. WhatsApp messages and offer messages

Reminders, receipts and welcome messages sent through Jimwala are included in your plan. Broadcasts (offers and notices) and automatic birthday wishes use offer messages, also called credits: one per member reached. The offer messages that come with your plan are shown on the pricing page, and you can buy more in packs (200 for ₹299, 500 for ₹699, 1000 for ₹1,299 at the time of writing). They are for messages sent through Jimwala only, have no cash value, cannot be transferred to anyone, and are not refundable. We may limit automatic messages that are clearly not for running a gym.

7. Your account

• Give us correct details and keep them up to date.
• Keep your login safe. You are responsible for everything done through your account, including by your staff.
• Tell us straight away if you think someone else has got into your account.

8. Your members' data

You decide what member data goes into Jimwala, and you are responsible for it. You promise that:

• You have the right to collect and use it, and members have agreed where the law requires, including for health-related details and for anyone under 18.
• What you enter is accurate and lawful.
• You will answer your members' requests about their data.

9. Messaging rules

You may use WhatsApp messaging in Jimwala only to contact people who have agreed to hear from you. You must follow WhatsApp's Business Messaging Policy and Business Terms, and you must not:

• Send spam, misleading messages, or anything illegal, abusive or harassing.
• Message people who have asked you to stop.
• Promote anything WhatsApp does not allow.

10. Payments between you and your members

If you take payments from members, a payment link from Jimwala opens a page that shows your UPI ID and the amount. The member pays your UPI ID in their own UPI app, so the money goes straight from them to you. Jimwala does not hold or handle it, takes no share and charges nothing on your members' payments. A payment counts as received only when you confirm it.

We are not the seller of your gym services. Refunds, disputes and complaints about your membership fees are yours to handle. Refund a member yourself, from your own UPI app or in cash, and record it in your dashboard.

11. Your content and your website

You keep ownership of the pictures, videos, text and other content you upload. You give us permission to store, resize and show it as needed to run your website and the service. You promise you have the right to use it and that it does not break anyone's rights or the law. We may remove content that does.

Each gym gets a free address on jimwala.com. If you connect your own domain, you must own it and you are responsible for keeping its settings correct.

12. Acceptable use

Please do not:

• Break the law, or use Jimwala for anything fraudulent.
• Try to get into another gym's data, or to disrupt or overload the service.
• Copy, resell or reverse-engineer the software.
• Upload viruses or content you have no right to use.

13. Availability

We work to keep Jimwala running, but we cannot promise it will always be available or free of errors. There may be maintenance, upgrades or problems outside our control (for example with WhatsApp, PayU or your internet). We may add, change or remove features.

14. Suspension and ending your account

You can stop using Jimwala at any time. Ending your account does not entitle you to a refund.

We may suspend or end an account, with a message to you where we can, if you break these terms, misuse messaging, do not pay, put other users at risk, or if the law requires it. We may also stop offering Jimwala by telling you in advance.

15. Our rights in Jimwala

Jimwala, its software, design, name and logo belong to us. These terms give you only the right to use Jimwala for your gym while your account is active.

16. What we do not promise

Jimwala is provided "as is". We are not your accountant, tax adviser or lawyer. Invoices, reports and reminders the software creates are there to help you, so please check that they meet your own tax and legal needs.

17. Limit on our liability

As far as the law allows, we are not liable for loss of profit, loss of members, loss of data, or any indirect or consequential loss. Our total liability for any claim relating to Jimwala is limited to the amount you paid us in the three months before the claim arose.

18. If a claim is made against us because of you

You agree to cover us for claims and costs that arise from your content, your messages to members, your members' data, or your breach of these terms.

19. Law and disputes

These terms are governed by the laws of India. Please write to us first at info@jimwala.com so we can try to settle a problem. If we cannot, the disputes will be decided by the courts at Muzaffarnagar, India.

20. Changes to these terms

We may update these terms. We will change the date at the top and tell account owners about changes that matter. If you keep using Jimwala after a change, you accept it.
